These General Conditions of Purchase govern the use of the website vegtus.com (hereinafter “the Website”), which is owned by VEGTUS 2020, SL (hereinafter VEGTUS). VEGTUS 2020, S.L is a public limited company with TIN B01661438 and its address at C/ Valldaura nº 8, 08195 Sant Cugat del Vallès, Barcelona, Spain and it is registered in the Companies Register of Barcelona, in Volume 47399, Folio 69, Page B-550629, Entry no.1. The customer’s use of the services of the online store implies, in all cases, adherence to the most recent version of the General Conditions of Purchase that are published at the time of placing the order. Therefore, it is advisable that the customer reads these General Conditions before making the purchase.

 

  1. SCOPE OF THE CONTRACT

These General Conditions of Purchase apply to the sale of all VEGTUS items through its website in the following countries – Spain, Italy, France, Germany, United Kingdom, Belgium, Andorra (see countries).

VEGTUS informs you that its website is solely intended for persons aged 18 and above and it reserves the right to cancel the customer’s login account if it detects any activities that are fraudulent, speculative or in bad faith when using this service.

 

  1. PURCHASE LIMIT

For security reasons, it is not possible to make purchases with a value above €10,000 or with over 50 items per order.

 

  1. PRICE

The applicable prices are those that appear on the website on the date of the order. The details of the prices are shown for each item and they include VAT (Value Added Tax), IGIC (Canary Islands General Indirect Tax), or IPSI (Tax on Production, Services and Imports in Ceuta and Melilla), as applicable. A breakdown of the shipping costs will be shown to the customer when they place the order.

 

  1. PAYMENT

Payment shall be made at the end of the purchasing process and it shall be a necessary condition for the completion thereof. Under no circumstances may payment be made later. No deferred procedures are permitted for making payments, such as cash on delivery, transfers or paying in-store when collecting the order. Accepted payment methods: Purchases may be paid for with Visa® and Mastercard® credit cards, as well as 4B or 4B Maestro debit cards, the Stripe System and the PayPal System. In any event, the payment method is selected during the purchasing process, on the relevant screen, and SSL secure data input security is used for all payment methods.

The person responsible for the transaction and entering the data is the payer or cardholder.

The customer must inform VEGTUS of any incorrect or fraudulent charges made to the card used for the purchases, by email or over the telephone, as soon as possible so that we can make the necessary arrangements. The providers or issuers of means of payment may adopt anti-fraud measures that lead to certain types of transactions being rejected. VEGTUS is not responsible for the application of these types of security policies.

 

  1. DELIVERY

The delivery period will be a maximum of 30 calendar days from the date of purchase. Orders will be delivered to the address given by the customer, according to the following characteristics:

The address provided by the customer may be a residential address, a workplace or any other address they wish to provide. The billing address does not have to match the delivery address. Our delivery company will send an email or SMS (if you provided a contact mobile number in your order) indicating the date on which the delivery will be made and offering the option to change the delivery date. On the scheduled delivery date, our delivery company will send an email or SMS (if you provided a contact mobile number in your order) providing an approximate time slot for the delivery.

5.2 Delivery issues: If it is not possible to make the delivery due to the absence of the recipient, the courier will leave a note to this effect and try to contact the recipient by telephone. After two failed attempts, the customer must contact the delivery company to proceed with the delivery.

 

  1. EXCHANGES, RETURNS AND CANCELLATION

There are different procedures for exchanges, returns and cancellations. The characteristics of each of them are detailed below, in addition to their costs and conditions.

  1. Exchange: exchange means replacement with the same product but in a different colour and/or size.
  2. Return: in the event of an imperfection or defect.
  3. Cancellation: at the customer’s discretion.

All products that are being exchanged or returned must be properly packaged.

When cancelling the order, you shall be solely liable for any loss in value of the goods resulting from handling them in a manner other than that necessary to determine their nature and characteristics and whether the goods function correctly.

 

6.1 CONDITIONS, REFUND AND PROCEDURE

Conditions (exchanges and cancellation): After receiving the product(s), you have 14 calendar days to cancel the contract, without having to give a reason. We do not offer exchanges as such, so you will have to return it/them and place a new order for a new product.

Conditions (returns): VEGTUS shall be liable for any defects that become apparent within the legally prescribed period.

Refund: Where appropriate, VEGTUS shall refund the respective amount without undue delay and, in any event, within 14 calendar days of the date on which notice of the return was received. The refund shall be paid via the same method of payment as was used to pay for it. However, we may withhold the refund until the goods have been received or until you have provided proof of return of the goods, whichever condition is met first.

  1. PRODUCT AVAILABILITY

If there are any problems supplying your order or if there are no products left in stock, the customer shall be informed immediately and we shall refund the amount for the product or products that are out of stock. VEGTUS shall refund the respective amount without undue delay and, in any event, within 14 calendar days. The refund shall be paid via the same method of payment as was used to pay for it. The information that appears on our website about stock availability in physical stores is for guidance only and may vary.

 

  1. WARRANTY FOR PURCHASED PRODUCTS

The warranty offered is as set forth in Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the Consumer Protection Act.

 

  1. CUSTOMER SERVICES

If you have any questions, suggestions, queries or complaints about the online store, you can contact the Customer Services Department in any of the following ways:

VEGTUS’s Customer Services Department will deal with and respond to your complaint as quickly as possible and always within a month. If your request is not dealt with satisfactorily, you may bring legal action or file your complaint through the website http://ec.europa.eu/odr, which will provide a single point of access to reach an out-of-court settlement, free of charge.

 

  1. CHANGES TO THE GENERAL CONDITIONS OF PURCHASE

VEGTUS reserves the right to change these General Conditions of Purchase at any time. Changes will not affect any orders that are already in progress.

 

  1. FORCE MAJEURE

VEGTUS’s fulfilment of all or part of its obligations shall be suspended in the event of an act of God or force majeure event that hinders or delays the fulfilment thereof. In particular, the following shall be considered as such, although this list is not exhaustive: war, riots, insurrection, social unrest, industrial action of any kind and supply problems that are not attributable to VEGTUS. VEGTUS shall inform the customer of any such act of God or force majeure event within seven days of it happening. If said suspension continues beyond fifteen days, the customer shall have the option to cancel the order that is in progress and they shall be refunded in accordance with the conditions set forth in point 6 of these General Conditions of Purchase.

 

  1. APPLICABLE LAW AND JURISDICTION

These General Conditions of Purchase are subject to Spanish law. Notwithstanding the foregoing, any customer who lives outside of Spain may also avail themselves of the protection that is guaranteed by the mandatory provisions of the law of the country in which they have permanent residence. To resolve any disputes, the parties voluntarily submit to the authority of the courts of the customer’s place of residence, waiving any other jurisdiction to which they may be entitled.
